Terms & Conditions.

1. Who you're agreeing with

“Skena”, “we”, “us” refers to Skena.io and its operating entity. By creating an account or using any feature, you enter into this agreement.

2. What we provide

Skena gives you access to AI-driven content generation tools. Currently in closed alpha, the live surfaces are Marketing Studio (product-photo to short-form ad video) and AI Character Studio (avatar identity creation from reference photos). Cinema Studio and Voice Studio are in active development. The service is provided on a credits basis. Free trial credits are granted on signup; additional credits are provisioned by the team during alpha and will be self-serve once the public payment gateway is live.

3. Your account

  • You're responsible for keeping your login credentials secure.
  • One account per person. Sharing accounts violates these terms.
  • You must be 18 or older to use Skena.
  • Alpha access is granted per-account at our discretion. We may revoke alpha access for any reason while the closed alpha is active.
  • We may suspend or terminate accounts that violate these terms or applicable law.

4. Content and ownership

  • Service IP.Skena and our suppliers own all rights, title, and interest in the service itself — the platform code, UI, branding, copy, model integrations, and anything else that's ours rather than yours. You may not remove copyright notices or proprietary markings from the service.
  • Your content. You retain ownership of all images and prompts you upload.
  • License to your content. You grant Skena a limited, worldwide, royalty-free license to process those uploads solely to deliver the service to you. This license is narrower than the standard SaaS clause — we do not claim sublicense rights or model-training rights over your uploads.
  • Your representations. You represent that you own or have permission to use everything you upload, and that none of it infringes third-party rights or violates applicable law. This applies in particular to reference photos used in AI Character Studio — you must have permission from any identifiable person depicted.
  • No training on your data. Skena does not use your uploads to train public AI models. Anonymized telemetry (job success rates, render times, error codes) may be used internally for service improvement.
  • Feedback.If you send us ideas, suggestions, bug reports, or other feedback about Skena, we may use that feedback to improve the service without any restriction, attribution, or compensation owed to you. Feedback is voluntary; sending it doesn't create a confidential relationship.

5. Generated output

  • Your ownership. You own the videos and assets Skena generates for you. We grant you a perpetual, worldwide, royalty-free license to use them for any purpose, including commercial advertising.
  • Your compliance responsibility. You're responsible for ensuring outputs comply with applicable advertising laws (BPOM for cosmetics / F&B, OJK for financial services, etc.) when used in Indonesia or your jurisdiction.
  • AI quirks. AI generation can produce unintended results. Review every output before public use.
  • No competing AI training. You may not use outputs (or any part of the service) to develop, fine-tune, train, or improve any AI / machine-learning model that competes with Skena, nor to seed datasets used for such training.

6. Acceptable use

6.1 Content restrictions

You agree not to upload, generate, or distribute content via Skena that is:

  • Unlawful, defamatory, abusive, or harassing
  • Sexually explicit, violent, or depicting minors inappropriately
  • Designed to deceive or impersonate real people, or that uses an identifiable person's likeness without their consent
  • Infringing on copyright, trademark, publicity, privacy, biometric, trade-secret, or other proprietary rights
  • Spam, junk, unsolicited bulk advertising, or unauthorized promotional schemes (sweepstakes, contests, pyramid schemes, etc.)
  • Hate speech, calls to violence, or content prohibited by Indonesian law (UU ITE, UU Pornografi, etc.)
  • Encouraging or assisting any third party to do any of the above

6.2 Service-use restrictions

You also agree not to (and not to permit anyone else to):

  • License, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the service or any part of it without our written permission
  • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying ideas of the service, except where applicable law expressly permits it
  • Use scrapers, spiders, crawlers, automated scripts, or similar tools to extract data from the service (legitimate search engines are exempt for the limited purpose of creating publicly searchable indices, but not for caching or archiving)
  • Use outputs or any part of the service to train, fine-tune, or improve any AI / machine-learning model that competes with Skena
  • Impersonate Skena, our staff, or any other person or entity, or misrepresent your affiliation with us
  • Interfere with the proper functioning of the service: introducing viruses or harmful code, overloading or flooding our infrastructure, attempting to bypass security controls, or accessing data you don't own
  • Remove or obscure any copyright, trademark, or proprietary notices on the service or on assets we provide

Violations may result in immediate account termination without refund per the Refund Policy.

7. Monitoring and moderation

  • Monitoring.Skena may, but is not obligated to, review, screen, or monitor uploads, prompts, generated outputs, and account activity for compliance with these terms and applicable law. We don't actively read your private content; automated checks may flag uploads that match prohibited-content classifiers.
  • Moderation rights. We may, in our reasonable discretion: remove or refuse to process content that we believe violates these terms; suspend or terminate accounts engaged in violations; modify or remove outputs that infringe third-party rights or threaten harm to users or the public.
  • Disclosure to authorities. If we reasonably believe applicable law requires it — or if we receive a valid legal process (court order, subpoena, request from Indonesian law-enforcement under UU ITE / KUHP procedures) — we may disclose information about your account or content to comply. Where law allows, we'll notify you before disclosing; some legal-process types prohibit such notification.
  • Reporting violations. If you see content on Skena that you believe infringes your rights or violates these terms, email support@skena.io with the relevant details. We aim to acknowledge within 1 business day.

8. Credits & refunds

Generation is metered in credits. Credits are prepaid amounts that unlock specific features within Skena. They are non-transferable between accounts, non-reloadable to a different account, and have no monetary value outside the cash-refund window described in our Refund Policy. Free trial credits granted on signup or by the team during the closed alpha are likewise non-cash.

Account closure forfeits any unused credit balance.If you delete your account or we terminate it for terms violation, remaining credits are zeroed. If you want a cash refund of unused purchased credits, request it within the 7-day window in the Refund Policy BEFORE closing your account. Cash refunds may be reduced by a processing fee of up to 6% to cover payment provider fees we can't recover.

Skena may adjust credit pricing or per-render cost as the product evolves. Material changes will be announced via email or in-product notice; pre-existing credit balances aren't devalued by such changes. The auto-refund-on-failure behavior described in the Refund Policy is already implemented and applies to all credit balances today.

9. Service availability

Skena strives for high availability but doesn't guarantee uninterrupted service. Scheduled maintenance, third-party AI / infrastructure provider outages, or force majeure events may cause downtime. We don't owe credits for routine maintenance, but jobs that fail because of an outage are auto-refunded under the refund policy.

10. Disclaimer of warranties

To the extent permitted by Indonesian law (including UU Perlindungan Konsumen, which sets a non-waivable floor on the disclaimers below):

  • Service “as-is”. Skena is provided on an “as-is” and “as-available” basis. We disclaim implied warranties of merchantability and fitness for a particular purpose to the maximum extent law allows. Nothing here removes statutory rights you have under Indonesian consumer law.
  • AI outputs. Generations are produced by AI models and may contain errors, omissions, factual inaccuracies, or unintended offensive material. Outputs may resemble existing third-party material. You are solely responsible for reviewing every output before publishing or commercial use, and for ensuring it complies with applicable advertising, IP, defamation, and likeness-rights law in your jurisdiction. Skena disclaims liability for output content to the extent law allows.
  • Alpha and experimental features. Skena is currently in a closed alpha. New features may be added, modified, or discontinued without notice. Alpha features are offered for experimentation only and carry no warranty beyond the floor set by Indonesian consumer law.
  • Third-party providers. Skena uses third-party AI processing and infrastructure partners to render outputs. We don't control how those partners operate. If a third-party failure breaks a render, the auto-refund-on-failure rules in our Refund Policy still apply on our side; we're not liable for the third party's own conduct or service quality.

11. Limitation of liability

To the maximum extent permitted by Indonesian law (including UU Perlindungan Konsumen, which sets a non-waivable floor):

  • Cap on liability.Skena's total liability for any claim arising from these terms is capped at the greater of (a) IDR 1,000,000 or (b) the amount you paid Skena in the 12 months preceding the claim.
  • Disclaimer of certain damages. Skena is not liable for lost profits, lost revenue, lost data, lost business opportunities, business interruption, cost of substitute services, or any indirect, special, incidental, or consequential damages — regardless of legal theory and whether or not we were advised the loss was possible.
  • User content. Skena assumes no responsibility for the timeliness, deletion, mis-delivery, or failure to store your uploads, generated outputs, or account settings beyond the retention rules in our Privacy Policy. Keep your own copy of anything you need to preserve.
  • Statutory carve-out.The cap and exclusions above don't apply to liability for death, personal injury, or fraud caused by Skena, or where Indonesian consumer law sets a higher floor. If those laws give you additional rights, those rights prevail.
  • Basis of the bargain. The limitations above are a fundamental basis of the agreement between you and Skena; Skena would not be able to provide the Service on the current pricing without them.

12. Term and termination

  • Term. This agreement begins when you create an account or first use Skena, and continues for as long as you have an active account.
  • Termination by Skena.We may suspend or terminate your account immediately if (a) you materially breach these terms, (b) we're required to by law, or (c) we reasonably believe your activity creates risk for Skena, other users, or third parties. We may also terminate access for any other reason with reasonable notice; if we do so without cause, unused purchased credits are refunded per the Refund Policy.
  • Termination by you. You can terminate this agreement at any time by closing your account. Email support@skena.io to request deletion; we process the request within 7 business days.
  • Effect of termination. On termination, your access to Skena ends and we may delete your uploads, generated outputs, and account data per our Privacy Policy retention rules. Unused credit balances are forfeited — if you want a cash refund of unused purchased credits, request it within the 7-day window in the Refund Policy BEFORE closing your account. Provisions that should reasonably survive termination — including warranty disclaimers, limitation of liability, ownership clauses, and licenses you granted us to process your uploads — survive.
  • No re-registration after termination for cause. If we terminate your account for breach of these terms, you may not re-register or access Skena under a different email, name, or identity.

13. Governing law

These terms are governed by Indonesian law. Any dispute that can't be resolved through direct contact with us at support@skena.io will be handled by the courts of Indonesia.

14. Changes to these terms

We may update these terms as the product evolves. Material changes will be announced via email or in-product notice; continued use after the change constitutes acceptance.
